			<content:encoded><![CDATA[<p>Jude Umeh outlines an interesting idea on his <acronym title="British Computer Society">BCS</acronym> blog on DRM. He notes the recent Memorandum of Understanding between the UK recording industry and six major ISPs, which essentially means that ISPs will monitor their networks for illegal filesharing in return for the music industry relaxing its previously zero-tolerance, anti-consumer position. Umeh notes that, on the face of it, this would seem to be a win-win for all parties involved. However, there&#8217;s still no getting away from the fact that this move to &#8220;ISP-RM&#8221;, as he terms it, involves ISPs monitoring their users&#8217; activity. Whatever the benefits, if it involves virtual snooping, the ends don&#8217;t always justify the means.</p>

While I can see his logic, I would be concerned that corporate espionage could almost become the standard if employees were allowed to start directly competing companies as soon as they leave their old employers. 			<content:encoded><![CDATA[<p>Jack Schofield blogs on The Guardian website that Microsoft are to expand their support of open file formats in Office. Next year&#8217;s service pack will bring XPS, PDF, PDF/A, ODF, and (in a sign of the increasing importance of Chinese business) the Chinese national file format UOF as standard. Additionally, the next version of Office will include updates to OOXML to reflect changes in the specification during the ISO approval process.</p>
<p>This is great news for open source, with the formats not only being natively supported but Microsoft also adding the ability to set them to be the default. While DOC and DOCX won&#8217;t disappear any time soon, this little sliver of openness is at least progress for a company which is famously closed-source.</p>

			<content:encoded><![CDATA[<p>In another post that I never got round to blogging, Boing Boing linked last month to a new study into copyright. Economist Rufus Pollock takes into account that the optimal copyright period on intellectual property will fall as costs of production reduce, and that the optimal level will fall over time in general. Putting this into a model, he finds that the optimal period is 14 years - much less than the many decades with which music, books and other media are currently protected. This conclusion adds weight to the broad contention that current protection periods overly restrict the fair use of these media.</p>

			<content:encoded><![CDATA[<p>The founder of Perfect 10, a website which specialises in &#8220;tasteful nude images&#8221;, has announced that he is suing Microsoft. Norm Zada&#8217;s convoluted claim argues that because some people illegally copy and post his images on their own sites, and because Microsoft in turn indexes and displays these images in its search results, Microsoft is infringing his copyright. As if suing Microsoft rather than the people who copied the images in the first place isn&#8217;t stupid enough, the case almost exactly mirrors Zada&#8217;s previous case against Google, which didn&#8217;t even reach court as it was ruled to have no merit.</p>

			<content:encoded><![CDATA[<p>The BBC reports that Google Video is to shut down its premium content service, leaving users who have purchased videos from the site high and dry. While the DRM&#8217;d media will stop working, Google is refusing to refund users and is instead only offering credits for its Checkout service. That&#8217;s bad enough, but factor in that Google Checkout is little used in comparison to eBay&#8217;s PayPal and that the credits will expire after 60 days, and it seems that customers have got a raw deal from the Silicon Valley sweetheart. This is appalling customer service, especially from a company as big as Google, and serves to highlight the dangers of buying DRM-protected content.</p>

Pirates will either opt-out of the nightly deletions or change ISP, while innocent customers are left wondering where grandma&#8217;s birthday video got to.</p>

The back cover of the sleeve states that unless the disc was sold to them for more than one dollar, the user does not have a licence to play it and it becomes the property of the record company. It also includes some bizarre clauses about the licence becoming invalid if the label on the record is defaced. Great stuff.</p>

Dubber had posted a link to a report on someone countersuing the RIAA. Paul Birch of Revolver Records responded, effectively claiming it was inappropriate to link to <strong>anything</strong> critical of the RIAA because Dubber works for a government-funded university. Huh? He then threatened to make an official complaint to Dubber&#8217;s employers. At least Dubber can rest easy, knowing it stands about as much chance of success as making your customers love you by suing them does.</p>

It has, however, served to emphasise that I hate hearing recordings of my own voice. Anyway, my point was this: Apple are rumoured to be planning a movie rental store, which would require modifications to the FairPlay DRM allowing files to expire after 30 days. While Steve Jobs has so far strenuously resisted the idea of a music subscription service, if Apple are willing to consider a movie rental service what&#8217;s to stop them doing the same with music in the future?</p>

While Apple refuses to explain, I hardly see major privacy implications in including this information as the only people it will significantly affect are those pirating music. As for the &#8220;danger&#8221; of thieves finding out the e-mail address of their victim, the EFF appears to be grasping at straws&#8230; Wired article <a href="http://blog.wired.com/music/2007/06/no_explanation_.html">here</a>.</p>

However, after Digg.com took down a link to an encryption key which could be used to crack the DRM on HD-DVD, users flooded the site with the hexadecimal code in a protest against censorship. After a futile attempt to keep up with the deluge, Digg gave up and proclaimed: &#8220;If we lose, then what the hell, at least we died trying.&#8221; Ironically, publicity over the attempt to comply with the law has resulted in the offending code being published all over the Internet.</p>
